The Government have observed that the Seniority of Professors for promotion to higher cadres i.e., Additional Directors of Medical Education / Principals of Govt. Medical Colleges / Superintendents of Government General Hospitals, has been a matter of contention in the courts of law for the past several years. The Government therefore, have constituted a Committee with the following members in the references 1st & 2nd cited to examine and finalise the seniority of the Professors:-
1. The Principal Secretary to Govt., HM & FW Dent., A.P., Hyderabad. -
Chairman.
2. The Secretary to Govt., G.A.D. Dept., -Member.
3. The Secretary to Govt., Law Dept., -Member.
4. The Director of Health, A.P., Hyderabad -Member Convener.
5. The Director of Medical Education, A.P., Hyderabad -Member.
6. The Commissioner, A.P.V.V.P., Hyderabad-Member.
In the reference 3rd cited, the A.P.A.T., basing on the observations of Hon'ble High Court in related W.Ps to the above subject of seniority of Professors, directed the Government to consider all the issues relating to seniority in the cadre of Civil Asst. Surgeons and finalise the seniority eligible Professors for promotion to the cadre of Additional Director of Medical Education.
Accordingly the Committee appointed by the Govt., has reviewed the Military seniority in the light of judgment of Hon’ble APAT vide reference 3rd cited wherein the Judgments of the Hon’ble Supreme Court have been cited to give the benefit by reckoning the Military service, has opined that such seniority for Military service shall be applicable to only those who have been recruited specifically at an emergency recruitment alone in the face of external hostilities and decided to withdraw the benefits for counting the service rendered in Army towards seniority for doctors who joined Army service as per the terms of Government orders issued in the reference 4th and 5th cited and decided that the ranks assigned by the APPSC as per the merit to the individuals shall alone be considered for the purpose of seniority for promotion to the higher cadres.
The Committee has also reviewed the matter of seniority to doctors appointed by the Private Managements of Kakatiya Medical College, Warangal and Rangaraya Medical College, Kakinada and subsequently taken over by the Government, in the light of Hon’ble Supreme Court of India Orders in Civil Appeal No.2478/2479 of 2000 in the matter of Union of India Vs Lalitha S.Rao and others wherein it was held that if the statutory recruitment rules do not provide for any other mode of recruitment other than by process of selection by the service commission the seniority of individuals appointed by any other process other than through service commission shall be after those who were recruited by the service commission and decided to modify the provisional seniority assigned to the above category of doctors and place them below the last successful candidate of the 1976 - 1977 APPSC selections.
Accordingly the Government have issued orders in the references 10th and 11th cited and finalised the seniority. As per the above Government orders the seniority list of Professors is given in the Annexure enclosed.
The Director of Medical Education and the Director of Health, A.P., are requested to take necessary further action in the matter and also place in their respective websites.
